Family Mediation

It is important to be well informed about the financial implications of the separation and divorce process with regards to mediations. Mediation is a fast, cost effective and confidential mechanism for mutually resolving issues on future responsibilities after separation and divorce. It comes highly recommended before court processes.

The process starts with a Mediation Information and Assessment Meeting (MIAM). MIAMs are separate individual meetings (45minutes-1hour) with a mediator where you give the mediator the background of your situation and what you would like to sort out and the mediator gives you an insight into mediation and helps you determine if it would be appropriate in your situation. Courts in the UK now require you to attend a MIAM. However, mediation is a voluntary process.

Where children are involved, it may be useful to have Child Inclusive Mediation, which though not binding may provide very useful information to help the parents make informed decisions. A Child Inclusive Mediator, especially trained to talk with children and young people holds a confidential meeting with the child(ren) and provides a verbal report on any information the child(ren)would want shared with the parents at the next mediation session.

On reaching an agreement in mediation, we would prepare for you a Memorandum of Understanding (MOU) and an Open Statement of Financial Information (OFS). Generally, these are only required where you have reached a mediated agreement regarding property and finances and require this to inform the drafting of a consent order by your solicitor.

Civil and Commercial Mediation

In order to give parties to a dispute of a value under £50,000 the option to employ a mediator at a reasonable rate, we are signed up to the CMC’s Fixed Fee Mediation Scheme. The fees for this service are set out below.
